Paris to New York flight delay or cancellation: what are your rights?

Paris to New York is a core transatlantic corridor, flown daily from Charles de Gaulle to JFK and Newark. The distance is approximately 5,800 km, which places it in the highest compensation band under EU261. The trigger is the same as on any other route: reaching your final destination three or more hours behind schedule, a cancellation notified with less than fourteen days' warning, or involuntary denied boarding.

On a long sector like this, delays of three hours or more are common enough that a great many passengers who are entitled to compensation never ask for it, usually because they assume a long-haul delay is simply bad luck.

How much you could be owed

Above 3,500 km, so the top band applies: €600 per passenger. There is an important qualification. Article 7(2) lets the airline halve the payment to €300 where it re-routed you and you arrived in New York less than four hours after the original scheduled arrival time. Past four hours, the full €600 stands. Compensation is per passenger and independent of the cabin or fare paid, and it is separate from your right to a refund or re-routing and from duty of care — meals, communication and a hotel with transfers if you are held overnight.

How late you reach New York decides the figure:

Arrival in New YorkEU261 compensation per passenger
Three or more hours late€600
Re-routed by the airline, landing less than four hours after the original arrival€300 if the airline halves it

Is the New York to Paris return covered by EU261?

Departing Paris, EU261 applies to every operating airline without exception, because the flight leaves an EU airport. A US carrier flying Paris to New York is bound by the regulation exactly as Air France is. The return direction is different and is where most claims fail: a New York to Paris flight operated by a US carrier is not covered, because arrivals into the EU are protected only when the operating airline is an EU or EEA carrier. The same New York to Paris route on a European airline is covered in full. Check the operator of your inbound flight rather than the airline whose code appears on the booking.

Which airlines fly Paris to New York?

Charles de Gaulle to JFK and Newark is typically served by Air France alongside US carriers including Delta, United and American, with seasonal variation in frequency and aircraft. Codeshare and joint-venture arrangements are extensive on transatlantic routes, which means the ticket you bought from one airline may well have been flown by another. The obligation under EU261 attaches to the airline that actually operated the flight, so that is the detail to establish before anything else.

How to claim

Use the free eligibility check to confirm the direction, the operating carrier and whether the flight is covered. We then calculate the band, assess whether an Article 7(2) reduction is arguable, and put the claim to the airline. Where extraordinary circumstances are asserted — severe weather, an air traffic control restriction, a security incident — the airline must prove both that the event occurred and that it took all reasonable measures to avoid the consequences. A refusal letter without supporting evidence is not the end of the matter. There is nothing to pay up front and nothing if the claim fails: one fixed €39 success fee, taken only once your compensation has been recovered.

How do you claim Paris to New York flight delay compensation?

Start with the flight itself. Our free flight check reads the recorded times for your Paris to New York flight and tells you which band it falls in, in about two minutes.

A Paris to New York compensation claim turns on two things: the arrival time, and the reason the airline gives.

For a late arrival, read the flight delay compensation guide. For a flight that never flew, read the cancellation compensation guide. It covers Paris to New York cancellation compensation too. Has the airline said no? The case law summary sets out what the courts make of the usual excuses.

FAQ

Frequently asked questions

Is New York to Paris covered by EU261?

Only when an EU or EEA airline operates it. On a US carrier the inbound leg is outside EU261, because arrivals into the EU are covered only where the operating airline is European.

What is the compensation for a delayed Paris to New York flight?

The route is approximately 5,800 km, so it is in the €600 band per passenger for an arrival three or more hours late, subject to the airline not proving extraordinary circumstances.

The airline paid me €300. Is that correct?

It can be. Article 7(2) allows the €600 to be halved on long-haul flights when re-routing brings you in within four hours of the original arrival time. Beyond four hours, the full €600 is due.

Does a delay caused by a technical fault count?

Usually yes. Technical faults are generally treated as inherent to operating an airline rather than extraordinary, so compensation normally remains payable on a three-hour-plus arrival delay.
