These terms govern your use of flightcompensations.com and the claim-handling service provided by The Upgrade Concierge LLC.

1. Who we are
FlightCompensations is a service of The Upgrade Concierge LLC ("we", "us", "our"). The Upgrade Concierge LLC is the contracting party for every claim you submit through this website, and is responsible for the service described in these terms.

2. What we do
We assess whether your disrupted flight may qualify for compensation under air passenger rights law, and — where you authorise us — prepare, submit and pursue that claim with the airline on your behalf.
We are a claims-management service. We are not a law firm, we do not provide legal advice, and information published on this website is general guidance rather than advice about your specific circumstances.
An eligibility result shown on this website is a preliminary assessment based on the information you give us. It is not a promise of payment. Whether compensation is actually due depends on the applicable law, the airline's evidence, the cause of the disruption, the notice given and your complete itinerary.
3. Fees
Checking your eligibility is free. There is no upfront charge to submit a claim.
If we successfully recover compensation for you, you receive the compensation awarded by the airline and we charge a separate fixed success fee of €39 per claim. The fee is fixed — it is not a percentage of your compensation.
If we do not recover compensation, you pay no success fee.
Priority Review is an optional one-time charge of €9. It moves your claim to the front of our internal review queue and can speed up our own processing. It does not change your legal eligibility, influence the airline, or improve the likelihood that a claim succeeds. It is separate from the success fee.
You choose how our fees are settled. By default they are taken from the compensation when it is recovered, so nothing is paid up front — and if the claim does not succeed, the Priority Review fee is waived and you owe nothing. Alternatively you may pay by card at the time of purchase and receive the full compensation when it arrives. Whichever you choose, our fees are fixed amounts and are never a percentage of your compensation.
FlightComp+ is an optional membership costing €49 per year. While a membership is active, covered claims are handled without the per-claim €39 success fee, and members receive priority internal review and flight-tracking features. Membership does not guarantee that any claim will be eligible or successful. It renews annually unless cancelled; if you cancel, benefits continue until the end of the paid term.
4. Who may use the service
You must be at least 18 years old to submit a claim. A claim for a passenger under 18 may be submitted by their parent or legal guardian, who accepts these terms on the passenger's behalf.
You must be the passenger named on the booking, or be authorised by that passenger to act for them. Where you submit a claim for other passengers, you confirm that each of them has authorised you to do so and to accept these terms on their behalf.
6. Claims covering more than one passenger
Where a claim covers several passengers on the same booking, the person who submits it is our point of contact and is responsible for the information provided for every passenger named.
The fixed €39 success fee applies per claim, not per passenger.
Where an airline pays a single amount covering several passengers, we pay it to the payment details given when the claim was submitted. It is then a matter between the passengers how it is divided — we cannot allocate it between you.
7. How claims are handled
We review your submission, verify the flight facts available to us, prepare the claim and submit it to the airline. We follow up and, where there is a reasonable legal and practical basis to do so, pursue an appeal.
We cannot control how quickly an airline responds, and we do not promise a resolution deadline. We keep you updated in your dashboard at each stage.
We may decline or discontinue a claim where there is no reasonable basis to proceed, where required documents are not provided, or where the information given proves inaccurate. We will tell you if we do.
8. Payment of your compensation
Where compensation is paid to us on your behalf, we will pay it to you using the payment details you provide, less any fees you chose to settle by deduction and any success fee due. Fees you have already paid by card are never deducted a second time.
It is your responsibility to give accurate payment details. Payments may be delayed if details are missing or incorrect.
Airlines sometimes offer vouchers, travel credit, air miles or another non-cash benefit instead of cash compensation. We will tell you if that happens and you decide whether to accept. Accepting a non-cash offer usually ends the claim, and the success fee is payable on the cash value the airline attributes to what you accepted.
9. Cancellation
You may withdraw your authorisation at any time by contacting us. Where we have already recovered compensation, or an airline has agreed to pay as a result of our work, the success fee remains payable.
Optional purchases (Priority Review and FlightComp+) are subject to the statutory cancellation rights that apply where you live. Contact us if you wish to exercise them.
10. Liability
We provide the service with reasonable care and skill. We are not liable for the decisions of airlines, for delays in their response, or for outcomes that depend on evidence outside our control.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, or for death or personal injury caused by negligence.
11. Your personal data
We process the personal data you give us in order to assess and pursue your claim, and we share it with the airline and other parties where that is necessary to do so. What we collect, why, who receives it, how long we keep it and the rights you can exercise are set out in our Privacy Policy at flightcompensations.com/legal/privacy, which forms part of these terms.
12. Use of this website
The content of this website — including our guides, rights explainers and airline information — belongs to The Upgrade Concierge LLC and is provided for your personal use. You may not copy or republish it commercially without our permission.
You agree not to submit false information, to use the service to pursue a claim you know to be unfounded, or to interfere with the operation or security of the website.
13. Changes to these terms
We may update these terms. The version in force when you submit a claim governs that claim, and the current version is always published on this page with its last-updated date.
14. Governing law
These terms are governed by the law of New Jersey, United States. Where you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection rules of the country in which you live, and you may bring proceedings in the courts of that country.
15. Contact and complaints
Contact support@flightcompensations.com with any question or complaint. We aim to acknowledge complaints promptly and resolve them fairly. If we cannot resolve a complaint, you may be able to escalate it to the national enforcement body for air passenger rights in the relevant country.
16. General
If any part of these terms is found to be unenforceable, the rest continues to apply.
If we do not enforce a right under these terms straight away, that does not mean we give it up.
These terms, together with the Privacy Policy and the letter of authority you sign, are the whole agreement between us about the service.
We may transfer our rights and obligations under these terms to another organisation; your rights under them will not be affected.
