Article 7(2) provides a qualification specific to long-haul: if the airline re-routes you and you arrive in New York less than four hours after the originally scheduled arrival, it may pay half — €300. Germany is an EU member state, so the Frankfurt departure is covered by EU261 whichever airline operates it — a US carrier leaving Frankfurt is bound in exactly the same way as a German one. The return is the direction to watch. A New York to Frankfurt flight operated by a US carrier is not covered by EU261, because arrivals into the EU are protected only when the operating airline is an EU or EEA carrier. Flown by a European airline, the identical route is covered. Passengers frequently assume a return ticket carries equal rights in both directions, and on transatlantic routes it often does not.
