Virgin Atlantic flight delay and cancellation claims pay £220 to £520 per passenger under UK261. You qualify if you land three or more hours late at your final destination, if Virgin cancels with under 14 days' notice, or if it denies you boarding. Virgin flies almost entirely long-haul, so most claims sit in the top £520 band.
Which law covers a Virgin Atlantic flight delay, UK261 or EU261?
Virgin Atlantic is a British long-haul carrier flying from Heathrow, Gatwick and Manchester to North America, the Caribbean, Africa, the Middle East and Asia, and a member of the SkyTeam alliance. It holds a UK operating licence, so it is a UK carrier, not an EU one:
- UK261 covers every departure from a UK airport and every arrival into the UK on Virgin Atlantic, including long-haul inbound flights from the US, India and beyond
- EU261 covers the rare Virgin departure from an EU/EEA airport, because the departure limb applies to any operating airline
- An arrival into the EU from a third country on Virgin Atlantic is not covered by EU261, which requires an EU/EEA carrier
Codeshares follow the metal: if your ticket carries a VS code but a Delta, Air France or KLM aircraft operated the flight, the operating carrier's status is what counts. Compensation is triggered by a three-hour-plus arrival delay, a cancellation with under 14 days' notice, or denied boarding after checking in on time.
What a delayed flight pays

Amounts are per passenger, not per booking. A delay of 3–4 hours over 3,500 km may be reduced by half under Article 7(2).
How much you could receive
Because Virgin flies almost entirely long-haul, most claims sit in the top band:
- GBP 220 / EUR 250 — routes of 1,500 km or less
- GBP 350 / EUR 400 — routes of 1,500 to 3,500 km
- GBP 520 / EUR 600 — routes over 3,500 km, which covers the bulk of the network
Under Article 7(2), where a long-haul flight arrives between three and four hours late the airline may pay half — GBP 260 or EUR 300 — with the full amount restored at four hours, so the exact arrival time at the gate matters. Upper Class and Premium passengers receive the same figure as economy, and every passenger on the booking claims separately.
When Virgin Atlantic doesn't have to pay
Compensation is excluded only where Virgin proves extraordinary circumstances that could not have been avoided even with all reasonable measures — severe weather, ATC restrictions, Heathrow slot or runway closures, security incidents and bird strikes.
The burden of proof is on the airline, not you. Routine technical faults discovered during normal maintenance and crew-rostering failures generally remain the airline's risk, and a strike by Virgin's own staff is normally not extraordinary, whereas ATC or third-party strikes usually are. A knock-on delay from an earlier rotation is not automatically extraordinary just because the first disruption was.
What evidence do you need for a Virgin Atlantic claim?
Keep the booking reference, boarding passes for every leg, the disruption notice, and receipts for anything you paid for yourself, and note the actual arrival time at your final destination rather than the delay on the first sector.
If Virgin refuses and the reasoning looks thin, UK claims can go to the CAA-approved alternative dispute resolution scheme it participates in or to the small claims track; EU departures can be raised with the enforcement body of the departure state.
