Does EU261 cover an EVA Air flight delay to Taipei?

EVA Air flight delay compensation pays €600 per passenger on departures from Vienna, Amsterdam, Paris or Munich to Taipei, and £520 from London. Flights from Taipei into Europe earn nothing under either rule. You qualify after a three-hour delay at your final destination, a cancellation with under 14 days' notice, or involuntary denied boarding.

EVA Air (BR) is a Taiwanese carrier and Star Alliance member, hubbed at Taipei and flying to London, Paris, Amsterdam, Vienna and Munich. It is not an EU or UK carrier, so your rights turn on the airport you leave from, not on the airline.

Because EVA Air holds no EU or UK operating licence, coverage lands on the departure side only:

  • Departing any EU/EEA airport on EVA Air — EU261 applies.
  • Departing the UK on EVA Air — UK261, the retained British version of the rules, applies.
  • Arriving into the EU/EEA or the UK from Taipei — not covered, because EVA Air is not a Community carrier. Inbound flights need an EU airline under EU261, or a UK or EU airline under UK261.

So a Vienna departure to Taipei is protected; the same aircraft flying Taipei to Vienna is not. Everything EVA flies out of Europe is long-haul, which puts eligible claims in the top compensation band.

A payment is triggered by a delay of three hours or more at your final destination, a cancellation with under 14 days' notice, or involuntary denied boarding.

Amounts are per passenger, not per booking. A delay of 3–4 hours over 3,500 km may be reduced by half under Article 7(2).

How much does EVA Air pay per passenger?

The sum is fixed by route distance, not by the fare, the cabin or your alliance status, and every named passenger with a confirmed booking claims separately.

  • EUR 250 — flights of 1,500 km or less
  • EUR 400 — flights of 1,500 to 3,500 km
  • EUR 600 — flights over 3,500 km, which covers EVA Air's departures from Europe to Taipei

UK261 claims pay GBP 220 / GBP 350 / GBP 520 on the same distance bands.

When EVA Air doesn't have to pay

Compensation falls away where the airline proves extraordinary circumstances outside its control and unavoidable even with all reasonable measures — severe weather, ATC restrictions, airport closures, security incidents or a bird strike.

Two things are commonly misstated:

  • EVA Air must prove the defence. A bare reference to "operational reasons" or weather is not evidence.
  • Own-crew strikes are generally not extraordinary, whereas strikes by air-traffic controllers or third-party airport staff usually are.

Routine technical faults discovered during normal maintenance are normally the airline's risk.

What should you keep for an EVA Air claim?

Keep the booking reference, boarding passes for every leg, and any email or app notification about the change. For a missed connection in Taipei, record the actual arrival time at your final destination.

Is the EVA Air eligibility check free?

Is my EVA Air flight from Taipei to Amsterdam covered?

No. EVA Air is a Taiwanese carrier, not an EU or UK airline, so a flight arriving into Europe from Taipei falls outside both EU261 and UK261. Coverage attaches to the departure airport, so only the outbound leg leaving Amsterdam, Vienna, London or another EU/EEA or UK airport is protected.

My EVA Air flight from Vienna was cancelled ten days before departure. What am I owed?

A cancellation with less than 14 days' notice normally triggers fixed compensation unless the replacement flight keeps close to your original times or EVA Air proves extraordinary circumstances. Vienna to Taipei is over 3,500 km, so the figure is EUR 600 per passenger, alongside your right to a refund or re-routing.

Does a Star Alliance connection beyond Taipei count towards my delay?

It can, if every sector sits on one booking that started in the EU/EEA or the UK. The regulation measures lateness at the final destination on the ticket, so a missed Taipei connection that adds hours to your arrival in, say, Manila can still support the full claim.
