Enter Air flight delay and cancellation: your rights

Enter Air is Poland's largest charter airline. It flies for tour operators rather than selling most seats itself, which is why the name on your ticket is often a travel company.

It holds a Polish operating licence. Poland is an EU state, so Enter Air is an EU carrier and EU261 covers its flights in both directions.

Amounts are per passenger, not per booking. A delay of 3–4 hours over 3,500 km may be reduced by half under Article 7(2).

Does a charter flight count for compensation?

Yes. EU261 makes no distinction between a scheduled seat and a charter seat. The airline that operated the flight owes the money.

The figure is €250 up to 1,500 km, €400 between 1,500 and 3,500 km, and €600 beyond that. Most holiday routes from Poland to Greece, Spain or Egypt fall in the middle band.

A package holiday can give you a second claim as well, against the tour operator, for the part of the holiday you lost. The two are different claims to different companies, and taking one does not waive the other.

Poland has the shortest deadline in Europe

A claim in Poland must be brought within one year. In the United Kingdom the limit is six. That gap catches people out, because a claim that is still alive in London can be dead in Warsaw.

The reform of EU261 that Parliament approved in July 2026 replaces the national limits with a single nine-month deadline across the EU. It is expected to apply from the second half of 2027. Until it does, the one-year Polish limit stands, so write early rather than late.

Is a charter flight covered by EU261?

Yes. The regulation covers charter flights on the same terms as scheduled ones. The airline that operated the flight owes the compensation, whoever sold you the holiday.

My tour operator says it is not responsible for the flight. Is that right?

The compensation claim is against the airline, so that part is correct. A package holiday can still give you a separate claim against the operator for the holiday time you lost.
