Delta is a US carrier, so EU261 and UK261 cover its departures from Europe but not its arrivals from America — direction decides the claim.

**Delta Air Lines flight delay** compensation **is** usually €600 per passenger on transatlantic departures from Europe, or £520 from the UK. You can claim when you land three or more hours late, when Delta cancels with less than 14 days' notice, or when it turns you away from a full flight.

Delta flights from the US into Europe are outside both schemes.

## Does Delta's partnership with Air France-KLM make its flights EU flights?

Delta Air Lines is a US carrier and a founding SkyTeam member, serving Europe from hubs including Atlanta, New York JFK and Boston. It works closely with Air France-KLM and Virgin Atlantic, but only its own licence counts, so coverage attaches to the airport you departed from, not to the aircraft.

- **Departing an EU/EEA airport on Delta** — EU261 applies, so an Amsterdam, Paris or Rome departure to the US is covered.
- **Departing a UK airport** — UK261, the retained British version, applies.
- **Arriving into the EU/EEA or the UK from the US** — **not covered**, because Delta is neither an EU nor a UK airline. Inbound flights need an EU airline under EU261, or a UK or EU airline under UK261. A New York to Paris flight on Delta sits outside both regimes.

Compensation is triggered by arriving at your final destination three or more hours late, a cancellation with under 14 days' notice, or involuntary denied boarding.

## How much you could receive

The amount is fixed by route distance, not the fare or cabin. Delta's European network is almost all transatlantic and over 3,500 km, so the top band is usual:

- **EUR 250** — 1,500 km or less
- **EUR 400** — 1,500 to 3,500 km
- **EUR 600** — over 3,500 km, covering nearly every Delta route out of Europe

UK261 pays **GBP 220 / GBP 350 / GBP 520**. Article 7(2) lets the airline halve the top figure where a re-routing lands you under four hours late. Each passenger claims separately, whatever the cabin.

## When Delta Air Lines doesn't have to pay

There is no compensation where the cause was an extraordinary circumstance unavoidable even with all reasonable measures — severe weather, air-traffic-control restrictions, airport closures, security alerts or a bird strike. The airline carries the burden of proof, which most passengers miss when a claim is refused in one line: a bare "operational reasons" note is not evidence. A strike by Delta's own crew is generally not extraordinary, whereas third-party strikes such as air-traffic controllers usually are, and routine technical faults from ordinary maintenance remain the airline's responsibility.

## How to claim from Delta Air Lines

Keep the booking reference, boarding passes and any notification of the change, and for a missed connection note your actual arrival time at the final destination, not the first delay. Delta processes claims through its own channels and may ask for verification before paying; we prepare the submission and any appeal. ### Delta and Air France sold my transatlantic ticket jointly. Does that make it an EU flight?

No. EU261 responsibility follows the operating carrier, not the joint venture or the code on the ticket. If a Delta aircraft flew the sector arriving into the EU from the US, it is outside EU261 because Delta is a US airline, whereas an Air France-operated sector on the same partnership would be covered. Check which airline actually operated each leg.

### Why is a Delta flight into Paris from New York not covered but the return is?

EU261 protects every departure from an EU/EEA airport whoever operates it, so the Paris-to-New York leg is covered. It protects arrivals from third countries only when the operating airline holds an EU licence, which Delta does not, so the New-York-to-Paris leg falls outside it. UK arrivals are treated the same way under UK261.

### My Delta flight from Rome was cancelled the day before departure. Can I claim?

Potentially yes, because the notice was under 14 days and the flight departed an EU airport, which brings it within EU261. Compensation is due unless Delta can prove an extraordinary cause outside its control, and you may instead take a full refund. Where you are held overnight the airline also owes accommodation and transfers regardless of the cause.
